A somewhat different note has been sounded from the Committee on Occupational Medical Practice of the American College of Occupational and Environmental Medicine. The committee pointed out that risks to laboratory workers resulting from spontaneous infection are presumably similar to those involved in vaccination. The positive aspect of immunization is that it renders possible control over the time and initial site of entry of the virus. These facihties are open to inspection for cGMP compliance by US FDA inspectors and for those facilities found to be in non-compliance with these requirements the material will be deemed adulterated with respect to identity, strength, quality and purity. Products from these facilities will be refused entry for seU or use within the USA. Data from these facilities may not be accepted in support of regulatory filings. 

It is potentially criminal to deny the inspector entry. Section 16 criminalizes violations of 15, and 15 prohibits refusing to permit an inspection. Even without the threat of criminal prosecution, a responsible corporate citizen should cooperate with any legally mandated inspection.

In 2009, this transfer of responsibility is exactly what the Conservative Party in the United Kingdom has announced as one of their key policies The power of Government inspectors will be drastically curbed by allowing firms to arrange their own, externally audited inspections and, providing they pass, to refuse entry to official inspectors. This policy is effectively a combination of the two approaches in transferring the inspection responsibility to a private party, envisaging that the private parties would self-police in the first instance but complement it with third-party inspections.

The OSH Act gives compliance officers the right to enter without delay to inspect. However, employers do have a right to refuse entry without a warrant, under the fourth amendment to the U.S. Constitution. However, employers must recognize that it is relatively quick and easy for OSHA compliance officers to obtain a warrant.
