Customs territory of the United States

Import is defined as causing the chemical to be imported into the customs territory of the United States. Customs Territory of the United States as used in general note 2 of the Harmonized Tariff refers to only the States, The District of Columbia and Puerto Rico. Therefore, importation into Guam, American Samoa, or other U.S. possessions or territories does not constitute manufacturing. Importers of chemicals into these possessions and territories are not bound by the regulations governing manufacturers unless they are subject to TSCA for some other reason. [Pg.50]

The exporter must submit a notification of export or of intent to export a regulated chemical substance or mixture. Not all importation onto soil governed by the United States requires import certifications.
