Contract deadline

Advances also often come in two parts, half upon signing the book contract, the other half upon acceptance of the final manuscript or publication of the book. This two-stage advance has led to interesting speculation about the prolific American short-story writer O. Henry. He was a master of surprise endings and often wrote about the life of ordinary people in New York City. The New York World paid him 100 for each of his stories, but because O. Henry did not always deliver his story by the deadline, his editor made sure only to pay half of the advance for the first half of the story and refused to pay the rest until the entire story was received. Some critics have said that this led to O. Henry stories with the second half nearly unrelated to the first Apparently, O. Henry sometimes rushed out anything he could for the first half of the story just to get the 50 and then ignored much of what he had written when completing the tale. [Pg.174]

Penalty clause - A provision in a contract that provides for a reduction in the amount otherwise payable under a contract to a contractor as a penalty for failure to meet deadlines or for failure of the project to meet contract specifications. [Pg.268]

The proposal cleared the Military Policy Committee on Jime 12,1944. On June 18 Groves contracted with the engineering firm of H. K. Ferguson to build a 2,100-column thermal-diffusion plant beside the power plant on the Clinch River in ninety days or less. That extraordinary deadline allowed no time for design. Ferguson would assemble the operation from twenty-one identical copies— Chinese copies, Groves called them—of Philip Abelson s 100-column imit in the Philadelphia Navy Yard. [Pg.553]

The increasing variety of products, a related increase in the number of products to be manufactured in smaller lots, and the intensified tendency toward automated manufacturing further increase the demands upon the manufacturing process and the assurance of the required product quality. Minimum stock-keeping by the automobile manufacturers also puts greater strain on injection molders, most of whom work under contract Under the just-in-time specifications, this particularly apphes to logistics and the meeting of deadlines. [Pg.101]

Due to the price level of medium-sized and large-scale projects, both parties will invest considerable time and effort in the price and deadline negotiations. Participants in contract award negotiations are often trained in negotiation techniques /2.40/. In this connection it may occur that so-called facilitating payments are expected. [Pg.54]

In case of the contractor s default due to the missed deadline end of test run , for which the contractor is responsible, liquidated damages will be charged. The liquidated damages amount to 0.5% of the contract price per full calendar week (alternatively per commenced calendar week) of the missed deadline, however maximum 5% of the contract price. [Pg.65]

In this connection, the term because of a fault on his part is important Owing to the competitive situation, contract deadhnes are always very close. Thus, during the project execution hardly anything may go wrong. Especially in the case of major projects this is nearly impossible and therefore the project management will always be concerned to establish proof of a disruption to the employer. This means the contractor is not responsible for the missed deadline and thus the claim for damages expires. This process is called daim in time. [Pg.65]

The contractor has to apply for the payment in writing and enclose corresponding evidence. Then the contract provides for the period in and the bank to which the payments have to be made, unless the employer raises any objection. If the employer exceeds the deadline without valid objections, the contractor is entitled to the payment of the resulting losses of interest. [Pg.69]

After the contract negotiations with all subcontractors relevant for the specific unit, a price and deadline competition as fierce as in the case of the main contract will follow. This is the task of the commercial project staff. Despite all competition it must not be forgotten to place the orders in time. [Pg.108]

Along with obvious terms such as work specifications, deadline for completion, price, and the way any dispute will be resolved—to name but a few—the written contract between an owner and an independent contractor should cover health and safety obligations, provisions that are particularly important in the mining context. For example, contract terms for work to be done by an independent contractor at a mine worksite often include these following health and safety subjects ... [Pg.234]
