Carrying of weapons

This view of the state constimtional provision is close to the viewpoint of most modern gun control advocates with regard to the Second Amendment Only the right of the state to form and operate a militia is protected the legislature is free to regulate or even prohibit the individual carrying of weapons. Certainly few people would assert that anyone has the right to carry a weapon while drunk. 

Louisiana The right of each citizen to keep and bear arms shall not be abridged, but this provision shall not prevent the passage of laws to prohibit the carrying of weapons concealed on the person. (Article I, Section 11)... 

Oklahoma The right of a citizen to keep and bear arms in defense of his home, person, or property, or in aid of the civil power, when thereunto legally summoned, shall never be prohibited but nothing herein contained shall prevent the Legislature from regulating the carrying of weapons. (Article II, Section 26)... 

Does making it easier for law-abiding citizens to carry concealed weapons deter criminals Will it increase the number of traffic, barroom, or other confrontations that escalate to deadly force If both, does the benefit of the first effect outweigh the cost of the latter ... 

The following states prohibit the carrying of concealed weapons Illinois, Kansas, Missouri, Nebraska, Ohio, and Wisconsin. 

Although it involves a knife rather than a gun, this case illustrates two continuing themes that will be applied to firearm regulation (1) the question of whether the right to bear arms is collective or individual, and (2) the application of the police power of the state to the types of weapons people may have and the manner in which they may be carried. This case cast an early vote for the collective position and upheld the state s police power. 

After reviewing similar cases in other states, the court ruled that so far as the act of 1837 seeks to suppress the practice of carrying certain weapons secretly, that it is valid, inasmuch as it does not deprive the citizen of his natural right of self-defence, or of his constitutional right to keep and bear arms. But that so much of it, as contains a prohibition against bearing arms openly is in conflict with the Constitution, and void. . . ... 

The defendant was convicted of carrying a loaded pistol within the limits of the city of Rutland, Vermont, in violation of an ordinance that provides that no person shall carry within the city any steel or brass knuckles, pistol, sling shot, stiletto, or weapon of similar character, nor carry any weapon concealed on his person, without permission of the mayor or chief of police, in writing. He appealed to the Supreme Court of Vermont. 

Gun rights advocates suggest that the same reference to the militia might imply that an individual would have the right to carry a weapon that if of a military nature (such as a fully automatic AK-47 or M-16 rifle). They also note that the defendant was not represented and that, therefore, the judges heard only one side of the case. (They also note in passing that short-barreled shotguns and carbines were in fact military weapons used by some cavalry units.)... 

The court in the Tennessee case oiAymette v. State upholds some measure of gun control by letting stand a ban on carrying concealed weapons. It bases its decision on English laws that had specified conditions under which weapons could be held. 

Kentucky All men are, by nature, free and equal, and have certain inherent and inalienable rights, among which may be reckoned . . . Seventh The right to bear arms in defense of themselves and of the state, subject to the power of the general assembly to enact laws to prevent persons from carrying concealed weapons. (Bill of Rights, Section I, par. 7)... 

The Buccaneer, with its capacity to carry nuclear weapons, was central to the Admiralty s vision of the aircraft carrier as the modem equivalent of the capital ship. In a remarkable paper, dated 2 March 1954, the Admiralty set out its views on expected trends in naval weapons down to the end of 1965. The news of the American hydrogen-bomb tests came too late to influence the paper, which, however, assumed that atomic weapons would be plentiful that the importance of air attack would increase but that long-range detection of submarines and torpedo countermeasures would reduce the underwater threat to surface ships. It was predicted that by the 1960s carrier-borne aircraft would carry nuclear weapons and would contribute to the strategic air offensive aircraft and 200-mile-range anti-ship missiles would have begun to... 

This type of weapon carries out all the stages of the cycle of operation, except that of firing, using energy which originates from the propint charge. The trigger must be released and then pulled for each shot fired...

Prestige of weapons work. In many cases, weapons work carries with it enough importance and prestige to ameliorate specialists needs for recognition, and most scientists are unwilling to trade their status of contributing to national security for defection or possible imprisonment.
