TSCA Lead Programs

The restrictions on lead under the Toxic Substances Control Act (TSCA) are just a small portion of the universe of lead regulation. This chapter is limited to an introduction to the TSCA lead programs, all of which focus on lead paint, the hazards inherent in removing lead paint, hazards from deteriorated lead paint, and renovations where lead paint is present. [Pg.631]

There are two primary TSCA lead programs, the Renovation, Repair, and Painting Rule and the Disclosure Rule. Both were authorized by The Residential Lead-Based Paint Hazard Reduction Act of 1992, codified as [Pg.631]

Of all the TSCA programs, the lead programs are the most actively enforced. About half of aU the TSCA-related complaints and proposed orders that the EPA issued in fiscal years 2001 through 2009 were for lead violations. Section 409 of TSCA subjects aU violations of the TSCA lead program to the civil and criminal penalties in TSCA 16. The current maximum daily penalty for a TSCA violation after January 12,2009 is 37,500. The maximum penalty is scheduled for review and possible increase to keep up with inflation in 2012 and every four years after that ... [Pg.646]

Most states have their own lead programs which have been authorized by the EPA and supplant the lead-based paint activities rule in subpart L. ° States and tribes may seek authorization under the Renovation, Repair, and Painting Rule in addition to the lead-based paint activities rule of Subpart L. Section 404 of TSCA ° requires state programs to be at least as protective as the TSCA program before the EPA can authorize them. In those jurisdictions where the state or tribal program has not been authorized by EPA, both the federal and state or tribal programs will be in effect. EPA plans to follow up on selected new chemicals during the commercialization phase. EPA altered its TSCA compliance inspection priorities over the last five years. In fiscal year 2005 there were 1611 TSCA inspections, of which 1191 involved the core chemical regulatory programs and 420 of which were focused on lead, asbestos, and PCBs.
