Service Contract Act

The 1960s saw the passage of legislation promoting workplace safety. The Service Contract Act of 1965, the Federal Metal and Non-metallic Mine Safety Act, the Federal Coal Mine and Safety Act, and the Contract Workers and Safety Standards Act all were passed during this decade. [Pg.17]

Some of the preexisting federal laws that are enforced by OSHA include the Federal Supply Contracts Act (Walsh-Healy), the Federal Service Contracts Act (McNamara-O Hara), the Contract Work Hours and Safety Standard Act (Construction Safety Act), and the National Foundation on the Arts and Humanities Act. Standards issued under these Acts are now enforced in all industries where they apply. [Pg.290]

The CM provides managerial services and acts as the owner s agent in construction matters. Rather than the owner contracting with a single GC, he contracts directly with multiple prime contractors and specialty subcontractors. The construction manager schedules, coordinates, and directs the day-to-day activities of these contractors. He generally does not perform any work himself, but he may provide essential services normally included in a GC s overhead cost, such as temporary facilities, utilities, cleanup, and security. These services are provided on a cost-reimbursement basis and are not part of the CM s fee. [Pg.1493]

A director of a company will operate under some form of service contract which will include, either explicitly or implicitly, a term that the director will take reasonable care in the exercise of his or her duties. A director has authority to exercise the powers which the company has given him. If in the exercise of such powers he breaches his duty of care either through negligence or by a deliberate act or omission, the director may be held liable for the breach, the consequences of which could vary from the death of an unconnected individual to financial loss by the company s creditors. The degree of fault required to impose liability on a director varies according to the consequence of the breach. This will depend upon whether he is liable under civil or criminal law. Breach of this contract will have the effect that the company could in theory sue the director, but the damages available to the company will be limited by the director s resources. In addition, the company may have difficulty showing that the company s loss is a consequence of the director s breach of contract. [Pg.7]

This amount carries widely among employers and is a critical variable in any risk analysis.
