Rights of people

A duly interposed demurrer alleged The National Firearms Act is not a revenue measure but an attempt to usurp police power reserved to the States, and is therefore unconstitutional. Also, it offends the inhibition of the Second Amendment to the Constitution— A well regulated Militia, being necessary to the security of a free State, the right of people to keep and bear Arms, shall not be infringed. ... [Pg.280]

Since the main objective of activation is the integration of the jobless into the labour market, defending the interests of the persons concerned would be a task of the ILO. However, due to its history, the ILO sees itself more as a lobbyist for people in work and less as a defender of the rights of unemployed or persons in activating measures. At least, the minimum standards stipulated in ILO Conventions can contribute to an improvement of the rights of people in the activation process. However, these ILO Conventions, contrary to the Convention on Human Rights, do not provide for an individual right to claim but are enforceable only in a relatively complex procedure on the political level. [Pg.11]

However, it may be wondered how the time-hallowed principle has been able to withstand the new approaches to international law as expressed in Africa, where the successive attainment of independence and the emergence of new States have been accompanied by a certain questioning of traditional international law. At first sight this principle conflicts outright with another one, the right of peoples to self-... [Pg.38]

Of course, classically, self-determination has been defined as the right of peoples freely to determine their political status and pursue their economic, social and cultural development. In practice, the application of this provision had been severely contextually reduced, in both its external and internal dimensions. As was noted at the outset, external self-determination in the sense of secession would appertain only to colonial peoples defined by prolonged colonial administration within uti possidetis boundaries. Internal self-determination would address both the constitutional system of public authority and the right of democratic participation in governance. However, it was simply presumed that any constitutional system and structures of governance were, merely by virtue of their existence, the product of free determination by the people concerned. Internal self-determination was therefore, until quite recently, practically irrelevant. [Pg.154]

Somewhat surprisingly, scholars have mostly taken the same stance. The very easy explanation as to why self-determination and minorities are not coimected is that self-determination is a right of peoples. As minorities are not peoples, they cannot claim self-determination. This is just one of the accepted truths in international law that is questioned in this project. [Pg.6]

Woodrow Wilson introduced the principle of self-determination for nations. It then became a right of peoples in de-colonization. What development took place Alfredsson gives a simple answer nation was too ethnically loaded and for all practical purposes in the United Nations, it was replaced by the term peoples. Both terms depict the exact same group of persons. So it is no longer a matter of national self-determination but a people s right to self-determination. [Pg.178]

Fourth, light needs to be shed on the issue for whom self-determination is actually applicable under recognized and accepted international law. It was introduced as a right for nations, and then it became a right of peoples. Considering that peoples and minorities are very close as groups, it has to be discussed how far international law has developed. [Pg.194]
