Recordkeeping requirements federalism

The FDA does not specify training documentation/recordkeeping requirements in the Code of Federal Regulations, but it has made them an industry requirement by virtue of precedent-setting industry demands.

Note Many states have their own OSHA-approved occupational safety and health programs. Contact your state s labor department to determine if you should comply with the federal OSHA regulations or your state s requirements. Most states follow the same recordkeeping requirements and use the same forms as the federal regulations. Also note that some insurance companies have their own forms that you can use instead of the OSHA forms. Check with your insurance carrier for information. 

The following table summarizes the recordkeeping requirements of the Federal Motor Carrier Safety Regulations under 49 CFR Parts 40, 382, 383, 387, and 390-399. See also 390.29 for general recordkeeping requirements, and 390.31 for information concerning photocopies. 

However, for other Part 1904 provisions, such as industry exemptions, reporting of fatalities and hospitalizations, record retention, or employee involvement, state-plan state requirements may be more stringent than the federal requirements. These states, however, have to get approval from federal OSHA to make such changes to the recordkeeping requirements.

The PESH Program has adopted all Federal OSHA standards and regulations apphcable to public sector employment, with the exception of the Recordkeeping Rule, 29 CFR 1904. New York promulgated and adopted an alternative approach to recordkeeping requirements, under section 801 and administrative instructions 901. 

The law stipulates that violations of federal pesticide recordkeeping re-qnirements will require the imposition of a fine not to exceed 500 for the first violation and a fine of not less than 1000 for the second violation unles sit is determined that a good faith effort to comply was made. 

Medical recordkeeping, covered by 29 CFR 1910.1020(h), requires employers to keep medical and training records for each employee. OSHA permits employers not to retain medical records of employees working for less than a year need if given to the employee upon termination of employment. Keep medical records confidential except for disclosures permitted by the standard or by other federal, state, or local laws. Make all medical records required by the standard available to OSHA. The compliance officer must protect the confidentiality of these records. If copied for the case file, follow the provisions of 29 CFR 1913.10. Consider records about employee exposure to bloodborne pathogens and documenting their HIV/HBV status as medical records. 

The recordkeeping reqrurements for this inspection are very specific and are provided in the regiilations. The inspection report or a copy of it must be kept where the vehicle is based or maintained, or at the company headquarters. Proof of the inspection must be on the vehicle as well. Proof can be a copy of the inspection report or a sticker showing the month and year of the last annual/periodic inspection. The requirements are the same if using a state mandatory inspection to satisfy the federal annual/periodic inspection requirements. 

Driver qualificatio procedures—This section of the written policy should include the company s hiring standard that meets all federal and state driver qualification requirements. In addition, the actual driver qualification procedures and the company s recordkeeping and retention procedures should be included here. 

The Bureau of Alcohol, Tobacco, and Firearms (ATF) of the Department of Treasury is responsible for issuing tax-exempt licenses for research use of ethyl alcohol. The ATF has very strict requirements for alcohol use and recordkeeping for its licensees, and this approval is one of the most difficult of all federal research licenses to obtain. The regulations are given in 27 CFR Chapter I. 

Wyoming has adopted the federal recordkeeping and reporting requirements identical to the federal rule, 29 CFR 1904.
