Similarly, if too much time elapses between the treatment and the injury, courts are reluctant to impose liability on a physician for harm to third persons. In Lester v Hall, a patient receiving lithium treatments had a car accident 5 days after his last treatment (43). The plaintiff alleged that the treatment was negligent and left the patient in an impaired condition that caused the accident. The court found the accident was unforeseeable given the 5 days between treatment and the accident. Additionally, the court refused to hold the physician liable for the accident because he had no direct supervision over the patient s actions. In weighing public policy and social utility considerations, the court found the burden imposed on a physician would be outweighed by the incremental benefits of warning. [Pg.379]

These similarities are offset by contrasts in their health insurance arrangements, access of patients to the political process, the authority wielded by physicians, and social insurance systems. For example, health care in the United States is generally seen as a private good associated with individual choice and the availability of menus for insurance, thereby rationing care by price. In Germany, by contrast, health care is seen primarily as a right or entitlement.
