AH discussion of the post-1965 era must begin with the Restatement (Second) of Torts, Section 402A. The person responsible for this section was Dean William Prosser, who became the reporter for American Law Institute s Restatement (Second) of Torts at a time when change was on the horizon in the field of products HabiUty. His initiative in drafting Section 402A provided the courts with a ready-made formulation for the adoption of strict tort HabiUty. Entitled "Special Liabihty of Seller of Product for Physical Harm to the User or Consumer," Section 402A reads as follows ...

Responsibility is in simple terms an area in which one is entitled to act on one s own accord. It is the obligation of staff to their managers for performing the duties of their jobs. I really believe this is about personal empowerment. It s important for people with chemical sensitivities to say, I don t have psychological problems. These products are poisonous and just because you don t understand that doesn t make it not so. All of us on this planet are entitled to be in a space where we are not poisoned or injured by others reckless behavior. 

Similarly, if one person is exempt from the EEC s notification requirements, this does not relieve any other person from the requirement to submit a PMN if that second person is not also entitled to the exemption.
