Legislature

In 1972 the U.S. Legislature passed PubUc Law 92-500, which requires certain levels of treatment for industrial wastewater discharges. Effluent guideline criteria (expressed as kilograms poUutant per unit of production) have been developed for each industrial category to be met by specified time periods.

Through individual state legislation, wherein the legislature adopted by reference a particular energy code or wrote the energy code requirements directly in the legislation. 

The latter view prevailed but generated yet another set of issues as to whether disclosure rules should be evaluated from the perspective of professionals or patients. Some courts took the narrower view of duty by ruling that professional standards should be used to determine what should be disclosed to patients. Although this theory of "lack of informed consent" was distinct from whether the health care provider had violated the standard of care, most courts, and many legislatures, confined the doctrine s operation to a very narrow set of circumstances consistent with the negligence standard underlying the standard of care in medical cases. Other courts took what is called the broader view and leaned toward the patient s perspective while requiring juries to impose the reasonable patient s view of risk rather than the particular patient s view of risks. 

In October of 2001, the CDC put together a draft model law for the states, Model State Emergency Health Powers Act. The proposed model law would give state officials broad powers to close buildings, take over hospitals, and order quarantines during a biological attack. The various state legislatures would have to decide to adopt, or not adopt, the model law. A CDC conference considered a summary of public health powers necessary for adequate response to a bioterrorism incident that is reproduced below. 

On behalf of an MCS task force, I testified before the legislature here in Santa Fe and helped to raise funds for an MCS awareness program. It is imperative to educate the public about this condition. Helping to make that happen feeds me on an emotional and spiritual level. 

Nor can women justly complain of any partiality in the adminis-(33) tration of justice. They have the sympathy of judges and particularly of juries to an extent which would warrant loud complaint on the part of their adversaries of the sterner sex. Their appeals to legislatures against injustice are never unheeded, and there is no doubt that when any considerable part of the women of any State really wish for the (40) right to vote it will be granted without the intervention of Congress. 

Wind power in the U.S. has not received this level of support. Every two years, a fight in congress erupts on the renewal of an important wind power tax credit. Similar battles occur in state legislatures that have wind power tax credits. According to U.S. energy officials, wind power could provide 5% of the nation s electric power by 2020, compared to the current 0.1%. 

Up until 2000, most laws regarding GHB and its analogues were primarily up to the legislature of each individual state. As... 

Another commentator adds, "Lots of time the decision-making process is really clear. .. it is not the person you talk to but two managers above or a fellow in the legislature who starts quoting data. They believe the scientist is some sort of manageable block and all of a sudden your number is going to be God s word. You are going to have to be protected in what you report."... 

To Emeritus Professor Everett Howe of the Berkeley Campus. Professor Howe was a very effective statewide coordinator of University Desalination Research, a job which required skillful liaison between the legislature and the research workers, in addition to a technological purview of the various projects.

Following Edward Jenner s discovery of a smallpox vaccine in 1798, and the demonstration by Benjamin Waterhouse in the United States in 1800 that the vaccine was effective, fraudulent versions of the vaccine were marketed throughout the country. A Baltimore physician, John Smith, initially convinced the Maryland legislature to enact a statute designed to ensure the availability of an effective smallpox vaccine supply, and then persuaded Congress to enact the Vaccine Act of 1813 - for the same purpose. This statute authorised the President to appoint a federal agent to preserve the genuine vaccine matter and to furnish the same to any citizen who requested it. 

NORML reports that every 9 seconds someone gets arrested for marijuana posession. NORML also reports that 28are there for drug related crimes. These people are not dangerous. They are there as victims of a witch hunt. Laws created by the legislature to protect me from myself demonstrate how totalitarian this country has become.
