Driver Vehicle Inspection Report .Part

Sec. 396.11 used to require a copy of the last day s Driver Vehicle Inspection Report (DVIR) be kept aboard the power unit of a commercial vehicle. Sec. 396.11 still exists, but this particular requirement (formerly Sec. 396.11(c)(3)) was eliminated three years ago. If your drivers are turning in daily DVIRs for each vehicle they operate, the DVIRs cover the required parts and accessories, critical defects are being corrected before the vehicle goes out again, and you are holding onto the DVIRs for at least three months, you are in compliance with the current DVIR requirements. 

SUMMARY FMCSA proposes to rescind the requirement that commercial motor vehicle (CMV) drivers operating in interstate commerce, except drivers of passenger-carrying CMVs, submit, and motor carriers retain, driver-vehicle inspection reports when the driver has neither found nor been made aware of any vehicle defects or deficiencies. This proposed rule would remove a significant information collection burden without adversely impacting safety. This proposed rule responds in part to the President s January 2011... 

Equipment Provided by Motor Carrier — A written vehicle inspection report must be prepared and signed by the driver at the completion if each da/s work on each vehicle operated. The report must cover at least the following parts and accessories ... 

Part 396 section (b) of the Code of Federal Regulations states that The report shall identify the motor vehicle and list any defect or deficiency discovered by or reported to the driver which would affect safety of operation of the motor vehicle or result in its mechanical breakdown. If no defect or deficiency is discovered by or reported to the driver, the report shall so indicate. In all instances, the driver shall sign the vehicle inspection report. On two-driver operations, only one driver needs to sign the report, provided both drivers agree with the report of the defects or deficiencies. If the driver operates more than one vehicle during the day, a report shall be prepared for each vehicle operated. ... 

To ensure that vehicles are in a safe operating condition while driven, the driver should check the whole vehicle carefully, pretravel and posttrip. These pretravel and posttrip inspection reports are an important part of a PMR If something seems to be wrong with the vehicle, stop and check it out. Do not continue with the trip until you are satisfied it is safe to do so.
