In connection with the notebook, which may be of significance, another valuable statement can be the conception records or patent proposals or disclosure sheets, or whatever other name is given to the formalized documents submitted by laboratory workers to a patent attorney or agent. The signature thereon may also become of great legal significance. Here, as well as in notebooks, a clear and concise description of the invention is important, but in contrast to the notebook, it can be more clearly directed to the point of invention than can the lab notebook which only serves to record step-by-step procedures, failures, and observations of no future importance. A record like this is of immense help to patent attorneys or agents in preparing patent applications, but also, if properly dated and witnessed, it may establish a provable date in an interference procedure. Thus, again, a routinely applied signature and witnessing procedure may convert a conception record, as well as a lab notebook, into a document of high legal value.

The U.S. PTO issues patents to those who are first to invent. In a contest over inventorship, any available record of invention is submitted to the U.S. PTO to estabUsh proof of an inventor s rights. As of January 1, 1996, any inventor from a country belonging to the World Trade Organization may use such evidence before the U.S. PTO. Previously, this type of proof could be rehed upon only if the activity, documented in the notebook, record, etc, was undertaken in the United States. Similarly, activity undertaken after December 8, 1993 in Mexico or Canada may also be rehed upon to prove inventorship.

The first set of case studies illustrates errors due to the inadequate design of the human-machine interface (HMI). The HMI is the boundary across which information is transmitted between the process and the plant worker. In the context of process control, the HMI may consist of analog displays such as chart records and dials, or modem video display unit (VDU) based control systems. Besides display elements, the HMI also includes controls such as buttons and switches, or devices such as trackballs in the case of computer controlled systems. The concept of the HMI can also be extended to include all means of conveying information to the worker, including the labeling of control equipment components and chemical containers. This section contains examples of deficiencies in the display of process information, in various forms of labeling, and the use of inappropriate instrumentation scales. 

Keep records that document when and what was invented. It is important that accurate records are kept showing your original sketches with a disclosure statement describing what and how your invention works. It is useful to have someone witness this disclosure document and verify the date that this invention took place. It is often during this step that the invention concept is either modeled (mathematical or physical or both) and tested. Thus, accurate records of these analyzes or test results should also be kept. In the U.S. it is the first to invent that will obtain a patent in the event of two individuals inventing the same thing.
