PEPAT is a legally binding instrument. According to Art. 26 of the 1969 Vienna Convention on the Law of Treaties Every Treaty is binding upon the parties to it and must be performed by them in good faith (17). 

The model language reflects the language used in the 1969 Vienna Convention on the Law of Treaties.

Authorises the Director-General, on behalf of the Organisation for the Prohibition of Chemical Weapons, to deposit with the Secretary-General of the United Nations as Depositary for the 1986 Vienna Convention the instrument of accession of the OPCW to the 1986 Vienna Convention on the Law of Treaties between States and Intemational Organisations or between Intemational Organisations. 

Jus cogens is defined in Article 53 of the Vienna Convention as a norm accepted and recognized by the international community of States as a whole as a norm from which no derogation is permitted and which can be modified only by a subsequent norm of general international law having the same character.
