Separation of powers

SUBSAFE has created a unique management structure they call separation of powers or, less formally, the three-legged stool (figure 14.2). This structure is the cornerstone of the SUBSAFE program. ResponsibUify is divided among three distinct entities providing a system of checks and balances. 

The new construction and in-service Platform Program Managers are responsible for the cost, schedule, and quality of the ships under their control. To ensure that safety is not traded off under cost and schedule pressures, the Program Managers can only select from a set of acceptable design options. The Independent Technical Authority has the responsibility to approve those acceptable options. 

The Independent Technical Authority (ITA) is responsible for establishing and assuring adherence to technical standards and policy. More specifically, they

Constitutional safeguards, including active utilization of governmental checks and balances, must be highly maintained. The system of checks and balances, through a separation of powers between the Legislative, Executive, and Judicial Branches of government, was created by the Constitution to prevent consolidation... 

Germany s justice system is based on the principle of a separation of powers. The administration of justice is supposed to be independent of politics. It does, however, have to conform to the law, and laws are passed by political bodies. So far, so good - at least as long as legislative practices in turn are committed to upholding the legal traditions that have evolved over time and have been tried and proven in practice. 

This means that he could also give binding orders in individual cases, and these orders had the force of law. This was expressly confirmed by the Reichstag in its well-known decision of April 26, 1942.141 In other words, in deviation from the principle of the separation of powers, Hitler as head of state could give an individual order which required the same obedience as does a law in a democratic state. 

Primarily, this is for the same fundamental reason as the previous point Nobody is completely trusted a priori in constitutional and similar states, in contrast to absolutist ones. Only by mutual control does one hope to achieve that an honest majority prevails. For the same reason, on a larger scale, separation of powers is considered necessary. Moreover, one strives to let individuals act without interference by authorities as much as possible. 

As a second example consider societal structures/govemments. At the extremes are autocracy and anarchy - complete order and complete disorder. In autocracy, the individuals in the state are all the same in that they all obey the rulings of the leader. In anarchy, each individual makes his/her own rules and each is unique. As social structures go, however, both autocracy and anarchy can be regarded as simple - and indeed characterize less civilized societies. Intermediate structures such as democracy, communism, and socialism are more complex - entities within them are incomparable. Indeed one of the most significant aspects of democracy in the US is the separation of powers into judicial, executive and legislative - three incomparable branches of government. 

The Supreme Court upheld the establishment of the United States Sentencing Commission against claims that it violated the doctrine of separation of powers and excessively delegated Congress s legislative authority. Mistretta v. United States, 448 US. 361 (1989).

Separation of power and signal cabling to the CRD mechanism is provided. One load cell and one position indicator are grouped together with their wires separated from the other system which supplies the other load cell and the other position indicator. The dc drive motor wires are grouped in a third cable to separate power from control.

It is in the principles that the pre-set values are supported. Principles VII-IX stress free will, responsible choice and democratic processes. The UN is willing to supervise processes of self-determination. In case of integration, the peoples should have equal status and equal guarantees of fundamental rights and freedoms. Non-discrimination is a basic principle. Due constitutional processes and the presupposition of separation of powers also support the pre-set values. 

The measurement of time accomplished finally completed a static world. Harrison s refinement of mechanism, with its separation of power and control, began to shape the way modem machinery is ordered, drawing the support parts out to become an armature independent of the workings. Structure conceived as an independently functioning part of a larger system would have profound consequence for the role assigned to its engineers.
