Legislation should be enforced. In the case of violations, legislation provides ample opportunities to correct and to sanction, based on common law, employment law, civil law, and/or criminal law. One should realise, however, that sector-specific situations require sector-specific actions and measures in order to correct and sanction sensibly and effectively. [Pg.211]

Looking around the corner, there are a number of sustainability issues that could be financially material in the chemical sector. A specific correction was introduced for the auxiliary services of the producers in the public energy sub-sector, whose purpose is to partly reduce the risk of an inadequate number of allowances, caused by the provision of auxiliary services and an increase in power electricity production. A maximum of 200,000 allowances, determined as the number of MWh of auxiliary services related to an increase in the output (positive regulation, dispatching reserve, quick start) provided in 2001 (data provided by CEPS a.s., electricity network provider) multiplied by a coefficient of 0.6 is added to the basic allocation. Because this adjustment is made inside the sector (no allowances were deducted or added for such purpose), adding these auxiliary services allowances to the basic allocation leads to an increase of the allowances to be allocated for that sector, and the allocations had to be reweighted back to the original number of allowances before this correction. It is important that policies for organic farming take the dynamic nature of the sector into account and make sure that there is a balanced application of supply/push and demand/pull measures by combining the key areas mentioned above in a manner adapted to the specific circumstances. In order to facilitate this it is recommended that member states develop action plans for organic farming which will then require periodic revision.
