CLAIMS REASSIGNMENT AND REEXAMINATION gives information oa post-issue actioas reissues from 1950, reassignmeats from 1980, reexaminations from 1981, exteasioas from 1986, expiratioa for nonpayment of fees from 1985, and reiastatements. 

Patent Reissue and Reexamination. Reissue proceedings and reexaminations proceedings require the resubmission of the issued patent to the U.S. PTO and should be expedited by the U.S. PTO. However, each requires the additional expenditure of substantial funds and a loss of time in the active life of the patent. 

A reissue may be ordered to correct any minor or major mistake which occurred during prosecution of a patent, but the mistake must be one that makes the patent partially or whoUy inoperable. Inoperable essentially means that the patent caimot be enforced. For instance, a reissue proceeding can be used to correct inventorship or even broaden claims if the patent is less than two years old. However, such a request to broaden claims in the context of reissue may not be undertaken to recover subject matter canceled during examination. Further, a reissue proceeding may be undertaken to correct formal problems or address newly discovered prior art which affects the scope of the claims. The nature of a reissue proceeding directs that this mechanism should be used only when the vaUdity of the patent is in question owing to the error or problem in question.

However, additional requirements are imposed at some plants. Sometimes the process operator must acknowledge the alarm s return to normal. Some plants require that the alarm occurrence be reissued...

The use of personnel not mentioned in the plan appears to he commonplace. Field personnel can change on some projects. The plan should contain some guidance on qualifications on personnel and should he used as a training aid for the replacement personnel. It would he advisable to immediately reissue the plan to include the current personnel roster, hut as OSHA has discovered, this is sometimes not done as quickly as one might hope. The authors believe that the situation mentioned above can likely be found on many sites even today. 

Reissue documents in their entirety instead of employing manuscript amendment or page replacement techniques. 

Denoting changes, revision marks, reissues, sidelining, underlining... 

The change should be processed in the same way as the original document and submitted to the appropriate authorities for approval. If approval is denoted on the front sheet of your documents, you will need to reissue the front sheet with every change. This is another good reason to use separate approval sheets. They save time and paper. 

The 1987 version of ISO 9001 required that documents be reissued after a practical number of changes have been made but this provision has been removed. 

However, there are practical reasons even in the IT age when it may not be prudent to reissue a document after each change. 

The International Maritime Organization (IMO) published a standard in 1984 for the design, testing and locating of deflagration and detonation flame arresters and high velocity vent valves for cargo tanks in tanker ships (IMO 1984). This was amended in 1988 and reissued as Revision I (IMO 1988). A new revised standard was issued in 1994 (IMO 1994).

Another important aspect for discussion is the impact of regulations, spe-cihcally the regulation on electronic document management and electronic signatures, 21 CFR Part 11, published by the Food and Drug Administration (FDA) for the hrst time in 1997 [1] (also see Chapter 26, which covers 21 CFR Part 11 in detail). Since that time the draft rules of Part 11 have been withdrawn and reissued along with various guidance documents [2-3], Some of the key points of Part 11 are as follows ... 

Another relevant guideline is that on manufacture of the finished product, CPMP/QWP/486/95 reissue (adopted April 1996). This includes a number of more detailed points relating to the manufacturing process, some of which should be taken into account in the development pharmaceutics and process validation sections of an application.
