Subsequent to April 16, 1981, the U.S. Department of Transportation promulgated new regulations amending 49 CFR 173.34 to eliminate the need for pressure relief device approval by the Bureau of Explosives. There are three types of TAP emissions continuous, intermittent, and accidental. Both routine emissions associated with a batch process or a continuous process that is operated only occasionally can be intermittent sources. A dramatic example of an accidental emission was the release of methyl isocyanate [624-83-9] in Bhopal, India. As a result of this accident, the U.S. Congress created Tide III, a free-standing statute included in the Superfund Amendments and Reauthorization Act (SARA) of 1986. Title III provides a mechanism by which the pubHc can be informed of the existence, quantities, and releases of toxic substances, and requires the states to develop plans to respond to accidental releases of these substances. Eurther, it requires anyone releasing specific toxic chemicals above a certain threshold amount to aimuaHy submit a toxic chemical release form to EPA. At present, there are 308 specific chemicals subject to Title III regulation (37). 

Because EPA was so slow in promulgating standards for HAPs prior to the 1990 Amendments, most states developed and implemented their own TAP control programs. Such programs, as well as the pollutants they regulate, differ widely from state to state. The ambient standards for a given substance are usually selected to be some small fraction of the TLV for that substance. 

Since SO2 and NO2 are criteria pollutants, their emissions are regulated. In addition, for the purposes of abating acid deposition in the United States, the 1990 Clean Air Act Amendments require that nationwide SO2 and NO emissions be reduced by approximately 10 million and 2 million t/yr, respectively, by the year 2000. Reasons for these reductions are based on concerns which include acidification of lakes and streams, acidification of poorly buffered soils, and acid damage to materials. An additional major concern is that acid deposition is contributing to the die-back of forests at high elevations in the eastern United States and in Europe.
