Inventions patentability

A patent also serves a defensive function. It provides the patentee with a partial or total shield that prevents others from patenting inventions which would ultimately restrict the patentee s commercial activity in the marketplace. 

For example, if the invention has cleaning properties it may be a composition of matter, process, or machine, all of which are patentable subject matter. If the invention performs work, it may be a process, article of manufacture, or machine, which are all patentable subject matter. It may also be that the development of a new composition results in a composition of matter and a process of using the composition, both of which are distinct, yet patentable inventions. The various types of patentable subject matter are not mutually exclusive and may be disclosed in a single patent.

Shortly afterward, a scandal erupted in Basel s small chemistry community when Switzerland s Nobel laureate complained publicly that the Geigy Corporation had not paid him the proper royalties on his patented inventions. When Muller hired a politically active lawyer to represent him, the story hit the Swiss newspapers. In the end, Muller became a vice director of Geigy and received a share in the profits. 

The tacky polymeric microspheres that comprise the pressure-sensitive adhesive layers of repositionable notes are patented inventions. The third invention reported by the authors [19] was related to sulfur oxidation, but the invention was not patented. It was only registered with the Statutory Invention Registration (SIR). What this means is that, it is not a utility patent as the rest of the documents considered in this Chapter, rather a SIR registered document containing the specification and drawings of a provisional application filed for a patent, which has not been subjected to examination yet. It is issued by the PTO, if the applicant, among other requirements, waives the right to receive a patent on the invention within such period as may be prescribed by the Commissioner. The invention such as this, on which a statutory invention certificate is published, is not a patented invention for most purposes.
