Legislative process

One of the six elements of Responsible Care is the Codes of Management Practice, and one of the codes is the Process Safety Code of Management Practices (34). This code emphasi2es management commitment and accountabiUty, information sharing, and community relations, but also includes 11 of the 14 specific elements of the legislated process safety management standards developed later.

Let us deal with this last issue first, and simply note that the laws listed in Table 11.1 each have their own history and were generally enacted quite independently. Their particular forms were fashioned out of a complex interaction of industry, consumer and environmental activist, and governmental constituencies that each brought its own agenda to the legislative process. It is not the purpose here to try to understand how these differences came about, but rather to explore some of the effects of these differences on the problem of deciding what limits ought to be placed on human exposures to environmental chemicals.

This chapter is written during the early days of the legislative process on the European Commission s New Chemicals Strategy and is a snapshot of the current position the final regulation may be changed from that which is outlined here and the reader must bear this in mind when doing further work on the subject. 

Food and drugs have traditionally been considered separate categories in the legislative process. Until relatively recently, health claims on foods were prohibited in many countries. However, in recent years consumers have been deluged with health information relating to their foods.
