Legal character

The world court in the Kosovo case accepted to answer this question on the merits. The Court first rejected a jurisdictional complaint raised by some states that unilateral declarations of independence are purely political acts and that, as such, they could not only be resolved through the application of domestic constitutional laws and not by international law standards. The Court rejected this assertion and stated that it could resolve this issue by referring to only international law, and that it need not refer to domestic law. The Court also reasoned that a political aspect of a given question does not deprive it of its legal character in its entirety. Thus, the Court held that it had jurisdiction to issue this advisory opinion on the merits. ... [Pg.79]

There are hidden gold mines under our noses—in house data becomes the new lamps for old on the tons of old clinical data from 50 years of R D— but of course, none of it is electronically accessible. It is called a library Many organizations have undertaken huge OCR (optical character recognition) projects to scan laboratory notebooks—some data even exists on microfilm and microfiche. As it is a legal requirement for a drug submission to provide provenance of scanned notebooks [38], paper, and microfilm, many businesses concentrate solely on the capture and verification of this data, rather than considering it a valuable resource to be remined. [Pg.180]

It is the character of Kennedy s friends rather than his own low personal standard of morality that explains why as a leader of the powerful Senate Judiciary Committee he has come forward as the leading sponsor of federal legalization of marijuana and why he has given his approval to decriminalization of heroin "for experimental purposes." The job of the Kennedy dynasty is to usher in British dope and the criminals who distribute it — through the front door. [Pg.290]

Patentable inventions must be useful, "reduced to practice" (35 USC, 102) and, by legal definition in most countries, also amenable to an industrial application. The German concept of a patentable invention describes it as "Lehre zum technischen Handeln" (teaching of a technical operation). The Polish law even requires a strictly technical character of the invention and currently excludes from patentability any biological product as well as pharmaceuticals and chemicals, even if these derive from a technical process. The technical process which is used to make such products, however, is patentable in almost all countries, irrespective of whether these refuse to grant patents on certain or all products of nature. [Pg.67]

Commission Decisions are strictly mandatory to those laboratories to whom they are addressed. Compared to a Commission Decision, a Council or Commission Directive has not the same legally binding character, but the general aims of a Directive have to be transposed into the member states national law. [Pg.161]

According to different legal traditions, the constitution can commit the state to provide an occupation for its citizens ( Right to Work ). As a rule, such constitutional principles normally have a mere programmatic character implying that the individual cannot deduce a direct entitlement. Still, these principles clarify that the integration into the labour market is not only the responsibility of the person concerned but that the creation of an adequate labour market is a duty of the state. Last but not least, sufficient job offerings are an essential prerequisite to a sustainable success of activation. [Pg.12]

The problem of preservation of the environment is a complex problem and has global character. The further development of mankind is impossible without the complex account of social, ecological, technical, economic, legal and international aspects of a problem as applied not only to a concrete production cycle, but also in scales of regions, the countries and all world. [Pg.118]

No man asserts that he or someone else has an illness without hope of gain. The potential gains, for oneself or others, from asserting such a claim—for example, securing medical help, monetary compensation, excusing crime, and so forth—are virtually endless. They depend on the claimant s character and motives, the social context in which the claim is advanced, and the ever-changing legal and social milieu in which medicine is practiced. [Pg.7]

Many consumers place excessive importance on alcohol content as an essential qnality factor. Most countries legally require the alcohol content to be displayed on barrels in retail shops and wine labels. In some cases, wines are priced on the basis of alcohol content. It is nevertheless true that there is a relationship between vinous character and alcohol content, on the one hand, and soft, fnll-bodied flavor, on the other hand. [Pg.52]
