FDA Authority and Internet Sales

The Food and Drug Administration (FDA) under the Food, Drug and Cosmetic Act, has the legal authority to take action against  

The sale or dispensing of a prescription drug without a valid prescription 

When the Internet is used for an illegal sale, the FDA works with the Department of Justice  

The action taken by the FDA and the Department of Justice is no different for an Internet pharmacy than a storefront. The FDA has investigated and referred numerous cases for criminal prosecution and initiated civil enforcement actions against online sellers of drugs and other FDA-regulated products, particularly sellers of drugs not approved by the FDA.
