An obvious solution would be to undervalue the work done, in order to avoid a claim from the client. The case of Lubenham Fidelities and Investment Co v. South Pembrokeshire District Council (1986) took care of any tendency to undervalue. In that case, the Court of Appeal ruled that the contractor might sue the architect in tort for any damages suffered by him because of the negligent valuation.

The entry into force of the Rome Statute of the International Criminal Court opens up new possibilities to bring offenders to justice. There can surely be little doubt that the wanton destruction of cultural property that we have wimessed recently constitutes a war crime within the meaning of Article 8 of the Rome Statute. Although neither Syria nor Iraq is party to the Rome Statute, the Court is able to exercise jurisdiction if the case is referred to the Prosecutor by the Security Council acting under Chapter VII of the UN Charter. In addition, a State Party to the Statute can refer a case to the Prosecutor where the alleged crime has been committed by a national of a State Party. ... 

In the similar case of DSC Retail Ltd v. Oxfordshire County Council which was taken to appeal, the High Court held tixat an offence coxild be committed under section 20 of the 1987 Act without evidence to prove that an indication applied to specific goods that were available at a specific price. DSG s price promise, although unqualified in its terms, was in application to be subject to conditions as to price. The High Court dismissed the appeal. 

According to the constitution of Pennsylvania, the president, who is head of the executive department, is annually elected by a vote in which the legislative department predominates. In conjunction with an executive council, he appoints the members of the judiciary department, and forms a court of impeachments for trial of all officers, judiciary as well as executive. The judges of the supreme court, and justices of the peace, seem also to be removeable by the legislature and the executive power of pardoning in certain cases to be referred to the same department. The members of the executive council are made EX officio justices of peace throughout the state. 

The other lawsuit was filed against the City of Atlanta seeking to declare the land transfer for the parkway null and void because of Mr. Arrington s conflict of interest. The ruling in this case was also reversed by the Court of Appeals. The appellate court invalidated the land transfer but left the City Council free to take whatever action it deemed fit to dispose of the parklands. 

It could seem that this section of the Road Traffic Act implies a legal obligation to carry out Road Safety Audits on new roads. In the case of Lamer v. Solihull Metropolitan Council in 2001, the court ruled that this section of the Act places a general duty on the local authority but that the local authority would only be in breach of the Act if it had acted in a totally irresponsible manner. The case of Gorringe v. Calderdale Borough Council made it clear that this is a target duty only and should be balanced against other duties placed on the local authority.
