Asbestos notification

Hotlines, either maintained by government agencies, universities, or organizations, offer a quick, useful resource for obtaining information or starting a path for further exploration. The hotlines here cover subjects from acid rain, air and asbestos to EPCRA and the Toxic Substances Control Act. A brief description of their contents and hours of operation are given. The EPA adopted ERPs for each of the major TSCA provisions. There is an ERP that apphes to violations of 4 test rules as well as one that applies to the Good Laboratory Practice rules estabhshed under one for 8, 12 and 13 adverse effect reporting and imports and exports," one for 5 including the premanufacture notification rules," one for PCBs," two for lead," and one for asbestos. ...

EPA National Emission Standards for Hazardous Air Pollutants (NESHAP 40 CFR 61 Subpart M) requires removal of asbestos before demolition, notification of EPA before removal, preventing release of fibers into the air, and waste disposal. 

A. This provision in the construction asbestos standard requires building and facility owners to notify tenants who will occupy building areas of the presence, location, and quantity of ACM and PACM in their spaces. This provision is triggered when any construction work, as defined by 1926.1101, is planned, per paragraph (k)(2)(i). The notification requirement is not limited to situations in which a disturbance of ACM or PACM will be taking place in the presence of the tenant. Tenants must be informed in advance in order to protect themselves from asbestos hazards, and so they may, in turn, inform any subtenants, housekeeping services, or other maintenance or construction employers that may be contracted by the tenants to perform work in the leased space where there is the potential for contact with ACM or PACM. 

A licence is not needed for people who carry out work with asbestos coating or asbestos insulation or asbestos insulating board in premises which they occupy, using their own employees. But they must give formal notification of this work to the relevant enforcing authority (see Regulation 5).

Therefore, compliance with Regulations 8 (licence), 9 (notification), 15(1) (emergency arrangements), 18(1)(a) (designated areas) and 22 (health records and medical surveillance) is not required in such circumstances. Those other Regulations which apply to all work with asbestos must be observed. 

If licensable work is undertaken, notification has to be given to the appropriate enforcing authority with details of the proposed work. This gives the enforcing authorities the opportunity to assess any proposals for carrying out work with asbestos and to inspect the site either before or during the work. 

Form FOD ASB5 can be used for notification, available from the HSE website, local HSE offices or from the Asbestos Licensing Unit. 

Subsection (a) (2) (d) includes, but is not limited to a conviction for failure to provide notification of a demolition or renovation involving asbestos regulated under the Clear Air Act.
