Direct regulation by the HMRI was rejected in the report as the Inspectorate did not have the comprehensive expertise required and there could be conflicts of interest between its regulatory and accident investigation roles. There had already been cases when a judicial Accident Inquiry was required by government because of the close involvement of the HMRI in the development of the relevant safety management systems or regulations. 

In accident inquiries the researchers must recognize the distinction between the accident event and the resulting injury event. The first event is caused, and the second is mainly the result of chance. Since both events seem complete in themselves, there is danger that inquiry will stop with analysis of the injury event only.
