Comprehensive federal laws, regulations, and guidelines help protect people who participate in research studies (called clinical trials). The U.S. Food and Drug Administration (FDA) regulates all gene therapy products in the United States and oversees research in this area. Researchers who wish to test an approach in a clinical trial must first obtain permission from the FDA. The FDA has the authority to reject or suspend clinical trials that are suspected of being unsafe for participants. [Pg.45]

In some cases, product labels and hazards to consumers. Warning statements may be indicated by prudence or required by law. For example, agencies such as the U. S. Food and Drug Administration or the Environmental Protection Agency may require that detailed instructions and warnings accompany products which they regulate. [Pg.281]

There are also key differences in the evaluation process for human and animal products due to separate language in the law and regulations and to human health considerations for drugs used in food animals. Unlike human drugs, each pharmaceutical product receiving U.S. Food and Drug Administration (FDA) approval for use in an animal species must be codified [i.e., cited in the U.S. Code of Federal Regulations (CFR), listed the 500 series]. The product information in each CFR citation is summarized in Table 3. [Pg.3978]

Although the Federal patent statute provides for 17 years of exclusive rights to an invention, the actual amount of time a dmg manufacturer is usually able to market its dmg without competition is substantially less. Because firms usually seek patent protection once a potential dmg compound is identified (284), a large portion of the patent period can be taken up by the sponsor s research and development (R D) activities and the U.S. Food and Dmg Administration s review of the marketing application (507). In 1984, Congress passed the Dmg Price Competition and Patent Term Restoration (DPCPTR) Act (Public Law 98-417), which allowed PTO to add up to five years to the patent term of dmgs when the patent term was eroded by regulatory review.8 As of May 1992, the PTO had issued 142 patent extensions most often for a period of... [Pg.292]
