TSCA requires that certain records be kept for specified periods of time. In addition to those records that are required to be kept, it should be considered whether there are other records that will be voluntarily kept and for how long. There is a five-year statute of Hmitations for actions by the EPA for TSCA violations, but in many cases records should be maintained for much longer. For example, records demonstrating that a substance qualifies for an exemption from the PMN requirements should be maintained for five years after the substance is no longer manufactured or imported, and not just five years from the date the records were created.
