Recordkeeping requirements programs

TSCA requires that certain records be kept for specified periods of time. In addition to those records that are required to be kept, it should be considered whether there are other records that will be voluntarily kept and for how long. There is a five-year statute of Hmitations for actions by the EPA for TSCA violations, but in many cases records should be maintained for much longer. For example, records demonstrating that a substance qualifies for an exemption from the PMN requirements should be maintained for five years after the substance is no longer manufactured or imported, and not just five years from the date the records were created. Recordkeeping requirements for each TSCA program are discussed in connection with those programs.

There is only a single recordkeeping requirement in Part 383 (when a driver notifies you of a conviction), but there are other important requirements that must be understood and incorporated into your safety program. 

Note Many states have their own OSHA-approved occupational safety and health programs. Contact your state s labor department to determine if you should comply with the federal OSHA regulations or your state s requirements. Most states follow the same recordkeeping requirements and use the same forms as the federal regulations. Also note that some insurance companies have their own forms that you can use instead of the OSHA forms. Check with your insurance carrier for information.

The officer may also ask to look at required inspection and training records and written programs, as well as the PPE hazard assessment.

Experience with Process Safety Management (PSM) systems has shown that the use of a program manual— in this case a SEMS Manual—can help management keep control of the program. This document, which would be part of the Recordkeeping requirement of SEMS, would show where all critical information is located. It would also serve as a structure for carrying out audits. 

This final rule also contains provisions for interested states, territories, and tribes to apply for and receive authorization to administer their own renovation, repair, and painting programs in lieu of the proposed regulation. States, territories, and tribes may choose to administer and enforce just the existing requirements of Subpart E, the pre-renovation education elements, the training, certification, accreditation, work practice, and recordkeeping requirements of this final rule, or both. A motor carrier is required to maintain a driver qualification (DQ) file for each driver it employs. The DQ file need not be physically one recordkeeping medium such as a file folder, but must be a filing system that is identifiable to a specific individual. Examples woiold include, in addition to a file folder, an electronic file such as a database program, or a filing system which may contain several physical files each labeled to a specific individual. The DQ file may be combined with the driver s personnel file.
