Programs Labeling Requirements

In general, labels must be durable and weather resistant, meet the size, color, and content specifications set forth in Sections 172.407-172.450, must be printed on, placed on, or affixed to, the surface of the package near the marked proper shipping name, be affixed to a background of contrasting color (or have a dotted or solid line outer border), and not be obscured by markings or other attachments. 

Multiple Labeling, and Mixed and Consolidated Packaging—Certain materials are deemed by the regulations to present such a risk, because of their multiple hazards, that they must bear multiple labels as specified in Table 14.1.

This section requires chemical manufacturers or importers to assess the hazards of chemicals which they produce or import, and all employers in SIC Codes 20 through 39 (Division D, Standard Industrial Classification Manual) to provide information to their employees about the hazardous chemicals to which they are exposed, by means of a hazard communication program, labels and other forms of warning, material safety data sheets, and information and training. In addition, this section requires distributors to transmit the required information to employers in SIC Codes 20-39.

The written program must define how the employees are to be informed of the requirements of the standard. This will include details of (1) how the employees are to be informed about the contents of the standard (2) the contents of the written plan (3) how they are to meet the labeling requirements (4) how they are to learn of the methods available to them to warn them of exposures (5) how to obtain and interpret a MSDS for a given chemical (6) the hazards associated with the chemicals to which they are exposed (7) how they are to be trained in procedures which will eliminate or reduce these chemical hazards and (8) how they are to react in an emergency. 

A specific part of the written plan must address how the employees are to be made aware of the labeling requirements and how they are expected to comply with this standard. It would be highly desirable to develop a uniform program across an organization, particularly as to labeling of secondary containers, to avoid uimecessary confusion. 

The DoD researchers might help focus the off-label requirement and specify the need for detectors with new assay capabilities (and contribute to the new assay development itself). It is not clear that a major role exists for the DoD laboratories to run large-scale repurposing panels or to perform detector repurposing development. After identifying and labeling all site permit-required confined spaces, the employer has two choices (1) designate such spaces as off limits to entry by any employee (unauthorized entry must be prevented), or (2) develop a written confined space program. The requirements for a written confined space program are covered in the next section. 

Make sure the provisions of the standard are understood. The requirements of the standard that deal specifically with the hazard communication programs are written hazard communication programs, labels and other forms of warnings, MSDSs, and information and training.
