From a procedural standpoint, unfavorable patent decisions by USPTO examiners (e.g., rejected patent claims/applications) can be appealed to the U.S. Board of Patent Appeals and Interferences (the Board). If the outcome at the Board is unfavorable to the applicant then the applicant may appeal the decision to the Court of Appeals of the Federal Circuit (CAFC). Unfavorable decisions from the CAFC may be further appealed by petition for a writ of certiorari to the U.S. Supreme Court.6 While patent appeals from the Board to the CACF may be made as a matter of right, appeals from the CAFC to the Supreme Court are not. In a petition of January 1648, the typical Leveller demand for the abolition of tithes without compensation to those who had a right to them was absent. As Wildman said, this was so as not to disengage any considerable party - he meant the independent congregations, some of which relied on tithes for their sustenance. Here a middle position is taken, one still reconcilable with the Independents interests. Impropriators were lay owners of rights to tithes.

EPA has 45 days to review each permit and to object to permits that violate the CAAA. If EPA fails to object to a permit that violates the Act or the implementation plan, any person may petition EPA to object within 60 days following EPA s 45-day review period, and EPA must grant or deny the permit within 60 days. Judicial review of EPA s decision on a citizen s petition can occur in the federal court of appeals. The public is guaranteed the right to inspect and review all permit applicahons and documents. There are provisions for three kinds of permit revisions administrative amendment, minor permit modification, and significant modification.

A petition against a restriction requirement is granted as an administrative action as opposed to a right of appeal, which relates to substantive actions. The difference is that a petition will be reviewed as an administrative manner by a group director or supervisor. Applicants will typically argue die merits of die restriction requirement at die time they make their election. Even if they do not file a petition at that time, their objection is preserved in the record should they wish to pursue a petition at a later time in die prosecution.
