Medical and exposure records

Employers must inform employees of the existence, location, and availability of their medical and exposure records when anployees first begin anployment and at least annually thereafter. Employers also must provide these records to anployees or their designated representatives, upon request. Whenever an employer plans to stop doing business and there is no successor anployer to receive and maintain these records, the employer must notify employees of their right of access to records at least 3 months before the employer ceases to do business. The OSHA standards require the employer to measure exposure to harmful substauces the employee (or representative) has the right to observe the testing and to examine the records of the results. If the exposure levels are above the limit set by the standard, the employer must tell employees what will be done to reduce the exposure.

Access means that an employee has the right and opportunity to examine and copy his or her medical and exposure records. It also implies that access must be provided in a reasonable manner and place. If you can t provide the material within 15 days after the employee s request, you are required to state the reason for the delay and the earliest date when the records will be made available. 

Responses to initial requests and new information that has been added to an initial request are to be provided without cost to the employee or representative. You may give employees copies of the requested records, give them the records and the use of mechanical cop5dng facilities so they can copy them, or lend them their records for copying off the premises. In addition, make medical and exposure records available, on request, to OSHA representatives to examine and copy.

When or if your company ceases to do business, you are required to provide the successor employer with all employee medical and exposure records. When there is no successor to receive the records for the prescribed period, you must inform the current affected employees of their access rights at least three months prior to the cessation of business and notify the Director of the National Institute for Occupational Safety and Health (NIOSH) in writing at least three months prior to the disposal of records. 

It is each employer s responsibility to preserve and maintain accrmate medical and exposure records for his or her employees. Section 1910.1020 imposes no obligation to create records, but does apply to any medical or exposure records created by yoru company in compliance with other OSHA rules or at your own volition. 

Medical and Exposure Records - Certain standards promulgated by OSHA require employers to monitor and measure employee exposure in certain instances, and to keep a record for the term of employment plus thirty years. Other standards require periodic medical examinations of employees, with records to be kept by the employer.
