There have been a wider variety of cases at all levels dealing with the regulation of firearms and, more recently, with civil liability of firearm manufacturers or dealers. However, because there are so many constitutional and civil issues involved in gun control litigation, the following list breaks down the decisions by topic. This is a case where the court chose not to legislate beyond traditional product liability law. There has been a great increase in gun liability litigation in recent years, and it is far from clear whether most courts will even-mally follow the approach in Kelley or the one here.

Although such conflict can arise from any one of a number of sources, conflicts can be resolved with little difficulty if a formula for bringing about a resolution has been put in place beforehand. Lack of such a mechanism can lead to a cascade of disharmony following a path which can end either in disengagement, renegotiation, arbitration, litigation or finally termination. 

Before following the fortunes of the parties litigant in the Court of Appeals, let us consider a rather fundamental question which concerns patents and their interpretation. In arriving at its decision, the court considered the two fundamental questions which are present in every patent suit, unless one of them is conceded or waived by the defendant. These are (1) Is the patent valid, and (2) if valid, is it infringed As you will infer, the court decided both questions in the affirmative, although some claims were held to be invalid.
