Governmental Notification

When tolling certain materials, the end of the toll may indicate the need to notify governmental agencies. Notification may be required to end any issued registrations for raw materials, intermediates, product or wastes or to let an agency know that a process is no longer covered under a previously applicable regulation.

Many countries have adopted chemical substance iaventories ia order to monitor use and evaluate exposure potential and consequences. In the case of essential oils used in many fragrance appHcations, these oils must be on many of these Hsts. New essential oils used in fragrances are subject to premanufactuting or premarketing notification (PMN). PMN requirements vary by country and predicted volume of production. They require assessment of environmental and human health-related properties, and reporting results to designated governmental authorities. 

Of all governmental regulatory agencies worldwide, the EPA probably has the most widespread application of, and expertise in, QSAR. The use is underpinned by TSCA, which provides the framework for the regulation of new industrial chemicals by the EPA. Within TSCA, Section 5 of the Act specifies the premanufacture reporting requirements for new chemicals. Within TSCA the burden of proof is placed on the EPA to demonstrate risk and exposure for a new chemical. The third and perhaps most important value that courts have incorporated into public decisions about risk is the principle that governmental actions should be explained to the concerned public. It may be hard for us to remember a time when agencies dealt in secret with the interests they were responsible for regulating, and made significant policy decisions without notification or opportunities for the public to comment. Yet the era of open government is not so old even in the United States and its equivalent has yet to materialize in many other Western democracies. 

Procedures should stipulate which other governmental organizations, if any, should be informed in the event of enforcement notifications. In some States, public notification is required or is undertaken as a matter of common practice.
