Advance notice of proposed rulemaking

OTS has focused its control efforts on two other chemicals in addition to PCBs. Working in conjunction with the Food and Drug Administration, EPA used TSCA s Section 6 to prohibit the use of chlorofluorocarbons (CFCs) as propellants in nonessential aerosol products. An advanced notice of proposed rulemaking under TSCA outlined approaches for restricting other uses of CFCs, but the attempt to deal with other CFC uses has been abandoned by the Reagan Administration. [Pg.218]

Publishing an Advance Notice of Proposed Rulemaking (ANPR) is sufficient to initiate a 4 rulemaking, but the EPA should not use an ANPR to unreasonably delay agency action. See NRDC v. EPA, 595 ESupp. 1255 (S.DJSI.Y. 1984). [Pg.315]

Once OSHA has developed plans to propose, amend, or delete a standard, it publishes its intentions in the Federal Register as a notice of proposed rulemaking, or often as an earlier advance notice of proposed rulemaking (U.S. DOT, 1991). The advance notice is to solicit information for use in drafting a proposal. A notice of proposed rulemaking will include the terms of the new rule and provide a specific time (at least 30 days from the date of publication, usually 60 days or more) for the public to respond. [Pg.37]

In 1979, an advance notice of proposed rulemaking was published by FDA in the Federal Register (44 FR 51233) describing FDA s philosophy on controlling lead in foods. It proposed various steps to expedite the reduction of lead in the food supply. Among these was the establishment of action levels for lead in canned infant foods, such as evaporated milk, formula, and juices, and subsequent action levels for lead in other food products consumed by adults but with priority given to foods fed to children at early ages. Our concern for adult canned foods... [Pg.23]

From the outset attempts were made to introduce new technology for occupant protection in the form of passive restraints. In July 1969 an advanced notice of Proposed Rulemaking entitled Inflatable Occupant Restraint Systems introduced the idea of air bags which would inflate during an accident to cushion occupants during the second collision between the occupant and the inside part of the car. The attractive feature of this safety device is that an individual can be passive since no action such as buckling is required of the occupants. A passive restraint standard was issued in 1971 but was overturned by the court until a suitable dummy could be developed for testing the performance of the restraints. [Pg.81]
