Sunset provision

New subsidies often outlive the public policy purpose that they were intended to address. The better-designed subsidies contain sunset provisions that require explicit action to reauthorize them after a certain time. Subsidy and externality policies arc often interrelated. It may be politically difficult to tax an energy source with high external costs, but much easier to subsidize a competing energy source with low external costs. Such second best solutions arc often implemented when political considerations block the preferred option.

As a result of the PDUFA legislation, the U.S. FDA has been able to reduce approval time of new pharmaceutical products from more than 30 months to approximately 13 to 15 months. The Act is ambiguous about whether EPA s authority under this Act is limited in time. One possible interpretation is that it will expire December 19, 2012, five years after the date of enactment. The ambiguity arises because this sunset provision is located in the discussion of EPA s authority to make grants, in 501, which uses the word section instead of title, when discussing the time limitation. Support for the alternative reading, that the sunset provision appHes to the entire title, is found in 503, which requires EPA to submit an annual report to Congress on all activities carried out in this title, until the expiration of authority as described in the sunset provision. 

Much was accomplished by the Institute. Seminars, workshops and symposia were held. Proceedings were issued. Presentations were made at safety conferences. And a book titled Safety through Design (Christensen and Manuele, 1999) was published and is still used. The Institute was disbanded in 2005 in accord with its sunset provisions.
