Storage facilities impoundments

The Brio refining site is approximately 58 acres in size and is the location of a former chemical production, recovery, refinery, and regeneration facility. The site includes closed impoundments into which hazardous substances were disposed in bulk, storage tanks, and approximately 1,750 drums of hazardous substances. Remediation activities included the excavation and incineration of contaminated soil, installation of protective liners around selected pits, and the installation of a groundwater extraction system adjacent to a gully. 

This series of prohibitions restricts how wastes subject to LDR requirements are handled. The most visible aspect of the LDR program is the disposal prohibition, which includes treatment standards, variances, alternative treatment standards (ATSs), and notification requirements. Land disposal means placement in or on the land, except in a corrective action unit, and includes, but is not limited to, placement in a landfill, surface impoundment, waste pile, injection well, land treatment facility, salt dome formation, salt bed formation, underground mine or cave, or placement in a concrete vault, or bunker intended for disposal purposes. The other two components work in tandem with the disposal prohibition to guide the regulated community in proper hazardous waste management. The dilution prohibition ensures that wastes are properly treated, and the storage prohibition ensures that waste will not be stored indefinitely to avoid treatment.

Storage — Post-accident storage fees of damaged vehicle(s) at a repair facility or impoundment yard must also be figured into your direct cost. 

Facility CERCLA defines facility as any building, structure, installation, equipment, pipe or pipeline, well, pit, pond, lagoon, impoundment, ditch, landfill, storage container, motor vehicle, rolling stock, aircraft, or any site or area where a hazardous substance has been deposited, stored, disposed of, or placed, or otherwise come to be located. Facility does not include any consumer product in consumer use or any vessel.
