Rulemaking process

Following the implementation of the remedy, the state or the potentially responsible party (PRP) assumes responsibility for the operation and maintenance (O M) of the site, which may include activities such as groundwater pump and treat, and cap maintenance. Once U.S. EPA has determined that all appropriate response actions have been taken and cleanup goals have been achieved, the site is deleted from the NPL through a formal rulemaking process. 

In at least one respect, the EPA s statements about when export notifications are mandatory are inconsistent with a court s statements. Public Citizen says the slow rulemaking process has failed to keep pace with the growing number of known hazards in American workplaces. One example cited in the report a lack of regulations for hundreds of chemicals identified as toxic by the National Institute for Occupational Safety and Health (NIOSH). 

Reacting to a recent decision by the Office of Management and Budget s (OMB) Office of Information and Regulatory Affairs (OIRA) to extend the Executive Order review of the standard, the AIHA called upon OIRA to finish its review without additional delay so OSHA can begin the public rulemaking process on a comprehensive standard and issue the rule as quickly as possible.
