Release of information

A toller may need to use resources outside their company to measure physical properties, conduct safety or other testing, engineer changes to piping or other facilities and equipment. This need frequently occurs for products in the initial development or commercialization stage. The toller should maintain confidentiality agreements with their suppliers and subcontractors commensurate with the proprietary nature of their client companies processes. Provision to allow disclosure of information to third parties should be addressed in the contract between the toller and the client. It may be structured so that the client must approve the toller s release of information to third parties.

This new rule, which updates 40.331 by adding a new paragraph, formally allows the release of test results and refusal to test situations to state licensing agencies without the driver s direct consent. The regulation was necessary because of already existing privacy protections in Part 40, which prohibit the released of information to third parties without the driver s consent. The general privacy protections in Part 40 will still remain in effect, and will also cover the information collected by the states. 

Ensure the confidentiahty of employee testing records by establishing policies for the release of information and by storing all testing records in a secure location with controlled access. 

Interviews with an injured person in regard to rehabilitation can involve a group and may include the supervisor, occupational health nurse, health and safety officer and rehabilitation specialist.
