Howto Determine if a SNUR Exists

In notice and comment rulemaking, which is an option for promulgating SNURs, the ERA issues a proposed SNUR in the Federal Register, and announces a thirty-day period during which anyone can submit comments on the proposal. The ERA must consider any comments it receives and may issue a final rule if it determines that a SNUR is warranted.

SNUR chemicals. All new SNURs are published in the daily Federal Register and it is relatively easy to check the Federal Register every day on line.  

Trade secrets greatly complicate SNUR compliance. Many times a supplier of a chemical will not disclose the names of all the chemicals in a product, and that makes it impossible to look for SNURs in the regulations or in commercial databases. The procedures for determining if a SNUR exists in this situation will be addressed later in this chapter.
