The appeal tribunal decision carries a further right of appeal, but only on a point of law, to the Social Security and Child Support Commissioners. This route can be exercised by either the applicant or DWP if they disagree with the decision. There is a further right of appeal from the Commissioners to the Court of Appeal or the Court of Session, and then to the House of Lords and European Court. Between 200,000 and 250,000 appeals are handled every year, and some 6,500 of these go on to the Commissioners or higher appeals (NAO 2003). Separately from the decision making and appeals process, claimants may complain about the handling of the administrative aspects to the Parliamentary Commissioner for Administration (the Ombudsman) through their Member of Parliament. [Pg.316]

English courts hearing civil actions are the country courts and the High Court in Scotland the Sheriff Court and the Court of Session. In Northern Ireland the County Court and the High Court deal with civil accident claims. Civil cases rarely have a jury in personal injury cases only in the most exceptional circumstances. [Pg.5]

For Scotland the Sheriff Court is an inferior court while the superior courts are the House of Lords, the Court of Session and the High Court of Justiciary. [Pg.7]

In a civil claim in the High Court or Court of Session Bertha Duncan, the plaintiff (pursuer), starts her action by obtaining a writ of summons and then serving this on Hazards Ltd. Hazards would consult their solicitors who would acknowledge service and indicate whether they intend to contest proceedings (if they do not, there may be judgement in default). [Pg.19]

Proceedings in the inferior courts are similar to those in the High Court and Court of Session, but quicker, cheaper and more under the direction of the court administrators. [Pg.19]

An appeal is possible from an industrial tribunal decision, but only on a matter of law. In respect of enforcement notices it is to the High Court in England and to the Court of Session in Scotland. In respect of other matters it is to the Employment Appeal Tribunal except in N. Ireland. [Pg.22]

The Employment Appeal Tribunal is a superior court associated with the High Court. It sits with a judge and 2 lay members, and all have equal voice. Parties may be represented by any person they wish, and legal aid is available. Further appeal is to the Court of Appeal (in Scotland to the Inner House of the Court of Session). In N. Ireland there is no Employment Appeal Tribunal. An Industrial Tribunal s decision may be challenged by review by the Tribunal itself, by judicial review by the High Court, or by way of case stated to the Court of Appeal. [Pg.22]

The High Court of Judiciary, in which a judge and jury sit, has a similar role to the Crown Court and appeals are made to the Court of Criminal Appeal. The Outer House of the Court of Session deals with civil cases In a similar way to the English High Court. The Inner house of the Court of Session is the Appeal Court for civil cases. [Pg.5]

The General Court of Massachusetts, January Session 1784, provided for the organization and government of the Militia. It directed that the Train Band should contain all able bodied men, from sixteen to forty years of age, and the Alarm List, all other men under sixty years of age,. ..
