Article 100A Directives

For the countries of the European Union (EU), the basic law is enshrined in the Single European Act (SEA) of 1986, through articles 100a and 118a. These articles cover the duty for each member country to legislate on health and safety. Many EU directives have been passed since that date and these have subsequently been covered in the legislation of the individual countries. For companies who are operating in a particular country within the EU, it is the law of that individual country which is applicable. [Pg.116]

Some years ago, Directive 94/9/EC (the so-called ATEX 100a Directive ), dated 1994-03-23 (following the title in French Atmospheres explosibles. .. and referring to article 100a of the Treaties of the European Community), introduced categories of explosion protected apparatus to give a guideline for their installation with respect to the risks that may be expected in different locations exposed to combustible atmospheres (Table 2.3). [Pg.33]

For explosion protected electrical equipment manufactured, type tested, certified and commissioned under the ATEX 100a Directive, the marking described in Table 5.2 shall be added by the marking code given in Table 5.3. The powers of the EU in heaith and safety iaw are derived from the Treaty of Rome 1957 and the Singie European Act 1986. For heaith and safety, the Singie European Act added two additional Articles 100A and 118A. The 1997 Treaty of Amsterdam renumbered them as Articles 95 and 138 respectively. Article 95 is concerned with health and safety standards of equipment and plant and its Directives are implemented in the UK by the Department of Trade and Industry. [Pg.9]
