As the overall liability of the State to provide air navigation services has been clearly identified by international treaty and, as already discussed, there are various kinds of air service providers ranging from State instrumentalities to private service providers, the liability regime could be varied and contentious. Clearly, liability of the State can be bifurcated into two areas under administrative law where liability of the State, its agency or a private body can be detained within the territory of a State, and international law, the latter involving principles of State responsibility and the liability of a State for causing injury to another State or its subjects. [Pg.33]

Of these, the responsibility of providing airports and air navigation services to aircraft lies clearly with the State. Article 28 of the Chicago Convention is clear on this when it states that each Contracting State undertakes, as far as practicable to provide in its territory, airports, radio services, meteorological services and other air navigation facilities to facilitate air navigational facilities. [Pg.33]
