Air miles

Herbaceous perennials can be planted in beds or borders by themselves, or mixed with bedding plants, shrubs, or roses. They can be placed in bold groups, lingering drifts, or small clumps, depending on the plant, its character, and the desired effect. Many flowers can be cut for flower-arranging, avoiding the high pesticide input and air miles associated with most commercial cut flowers. 

Orchards are special places, and were highly valued in medieval times as gardens in their own right—offering shade, enclosure, tranquillity, and, of course, nutritious fruits. With so much of the fruit that we eat nowadays coming from miles (even air miles) away and picked before it is beginning to ripen, you may wonder why we have allowed so many orchards to die out or be felled for intensive agriculture or land development. An orchard offers you the chance to eat your own ripe fruit and choose from an array of wonderful varieties that aren t available in stores. 

Eastward of the Cascade Range, twenty air miles east of the city of Yakima, the blue, cold, fast-running Columbia River bends east, then northeast, abruptly ninety degrees southeast and finally due south through a flat, arid scrubland on its last excursion toward the continental interior before it makes its great bend below Pasco to course directly westward two hundred fifty miles to the sea. Even that far inland the river is wide and deep and veined in season with salmon, but the sandy plain surrounding wins little of the river s water and the barrier of the Cascades denies it more than six inches a year of rain.

Motion Picture Production Site — A driver of a commercial motor vehicle transporting property or passengers to or from a theatrical or television motion picture production site may not drive more than 10 horus following 8 consecutive horus off dut3nvhen driving within a 100 air-mile radius of his/her normal work reporting location. 

If the driver operates beyond a 100 air-mile radius of his/her normal work reporting location he/she is subject to the 11-hour driving rule. 

Local Christmas Deliveries — The on-duty rule does not apply to a driver of a vehicle engaged solely in making local dehveries from retail stores and/or retail catalog businesses to the ultimate consumer when he/she is driving within the 100 air-mile radius of his/her work-reporting location during the period from December 10 through 25 each year. 

Note A driver who uses this exception is not eligible to use the 100 air-mile radius exception, sleeper-berth exception, or the property-carrying driver (16-hour exception). 

Construction Materials and Equipment — The driver of a CMV (who is used primarily in the transportation of construction materials and equipment) may restart his/her 7- or 8-day clock after an off-duty period of at least 24 consecutive hours. The transportation of construction materials and equipment is defined as the transportation of construction and pavement materials, construction equipment, and construction maintenance vehicles by a driver, to or from an active construction site within a 50-air-mile radius of the normal work reporting location of the driver. This exemption does not apply to drivers transporting placardable amounts of hazardous materials. 

Also, the mandatory rest break requirement does not apply to a driver who qualifies for the 100 air-mile radius exception. 

The driver can cross a state line and stiU come rmder the 100 air-mile radius exemption, if the criteria listed above are met. 

A 100 air-mile radius driver is not exempt from the 60-hoiu /7-day or 70-hour/8-day limit. 

Drivers who quahfy for the 100 air-mile radius exception or the short-haul (non-CDL) exception are not required to comply with the mandatory break provision. 

Waiting time is not included in calculating the 14-hour duty period. A driver using the waiting time provision may not use the 100 air-mile radius exception. 

An urban carrier (a carrier operating entirely within a radius of 100 air miles) with a recordable accident rate greater than 1.7 will receive an unsatisfactory rating for the accident factor. 

Even though your drivers may be exempt from filling out a log, your operation must still maintain records of any driver taking advantage of the 100 air-mile-radius exception. 

Keep in mind that along with all of the above, drivers utilizing the 100 air-mile-radius exception must still ... 

Since the 100 air-mile-radius exception is a federal regulation, crossing state lines is not an issue. This is an interstate regulation, so by definition, whether or not a driver crosses state lines while utilizing the exception is irrelevant. 

In the event a driver is occasionally assigned a run that would force him or her to exceed the 100 air-mile radius, for that run, the driver would simply defer to a record of duty status. And in this situation, no previous 7-day documentation is required.
