Who Is Covered

OSHA cannot fine another federal agency for failure to comply with OSHA standards, and it does not have authority to protect federal employee whistleblowers. Federal employee whistleblowers are protected under the Whistleblower Protection Act of 1989 (OSHATI, 1994, chap. 1). 

Although OSHA applies to federal government employees, and requires federal agencies to provide safe and healthful places of employment, OSHA does not have the authority to fine another federal government agency. Compliance issues raised at a lower organizational level are raised to a higher level until resolved.

The Fourth Amendment is 54 words long. It is divided into two general parts. The first 24 words are important. It pertains to what the amendment prohibits. It states who is covered ( the people ), what is covered ( persons, houses, papers, and effects ) and nature of protection ( to be secure... against unreasonable searches and seizures ). This part of the Fourth Amendment is usually described as the Reasonableness Clause or reasonableness requirement.

This definition includes pharmacies.

The policy should clearly define who is covered. Generally all employees, both full-time and part-time, are required to participate. Contractors, visitors, and vendors may be covered by their own company programs. Each company employee will be given a copy of the company standard and will be expected to sign an agreement document such as that given in Table 7.7. 

In determining who is covered by the Bloodbome Pathogens standard, remember that if an employee is providing first aid or CPR as a Good Samaritan and not as a trained first aider, designated to perform first aid by the employer, that employee is not covered by the standard.
