It is not difficult to understand the reasons why the alcohol industry was concerned with the National Academy of Sciences report. If the recommendations were adopted, they would have a detrimental impact on the profits of alcohol companies. Representatives of the committee who conducted the National Academy of Sciences study did testify before the Senate Subcommittee on Substance Abuse and Mental Health Services, Committee on Health, Education, Labor and Pensions, on September 30, 2003. However, the power of the alcohol industry should not be doubted. As the number one political action committee in contributions to the Republican Party, which controlled both houses of Congress, the Beer Wholesalers Association was successful in blocking the implementation of any of the recommendations. 

With George W. Bush in the White House and the Republican Party controlling both houses of Congress in 2001, the business community believed that the time was ripe for another attempt to shape state common law through federal legislation.
