Paperwork Reduction Act

The Commission was required to obtain 0MB clearance before it could begin the study because the number of special orders to be sent triggered the requirements of the Paperwork Reduction Act of 1995, 44 U.S.C. Ch. 35, as amended.

The Paperwork Reduction Act requires each agency, including the EPA, to obtain approval from the Office of Management and Budget (OMB) before collecting information from ten or more members of the pubHc. The OMB issues a confirmation, referred to as an OMB control number, for each approval it grants. The EPA cannot penaHze any person for faffing to respond to a request for information unless the EPA s request for information (i) has a vahd OMB control number and (ii) states that no response is required unless there is a valid OMB control number. OMB approvals are valid for only three years. 

If the EPA does not comply with these requirements of the Paperwork Reduction Act, a respondent can raise the noncompliance as a complete defense to a penalty proceeding. As a result, a respondent in a penalty proceeding charged with failing to prepare records or submit information to the EPA should check to be certain that the EPA obtained a valid OMB control number for the information request, and published the required notice with the call for information. The EPA cannot impose a penalty if it did not comply with the Paperwork Reduction Act. ... 

The information collection requirements contained in this rule have been submitted for approval to the Office of Management and Budget (OMB) under the Paperwork Reduction Act, 44 U.S.C. 3501 et seq. An Information Collection Request (ICR) document prepared by EPA, an amendment to an existing ICR and referred to as the ICR Final Rule Addendum (EPA ICR No. 1715.10, OMB Control Number 2070-0155), has been placed in the public docket for this rule. The information collection requirements are not enforceable until OMB approves them.
