Legal action perceptions

In 1983, WDATCP adopted a permanent rule (13) establishing 10 ppb as the "action level" which triggers designation of a moratorium area. Legal concerns over the public s perception of how moratorium boundaries were established under the emergency rule led WDATCP to establish the boundaries as a circle of 1-mile radius (approximately 2800 acres for each moratorium area established from a single contamination site) around locations where aldicarb residues exceeded the enforcement standard. The center of the moratorium area is the center of the quarter/quarter section of land on which the well is located.
