John Deere

A commercial CNG bus with a John Deere 8.1 liter engine will undergo modifications to the engine for operation on a mixture of 30% hydrogen and 70% natural gas by volume. This is expected to reduce emissions of NOx substantially without a significant reduction in engine power.

From our review of the statutory language of 103 as well as the application of that statute as spelled out in Graham v. John Deere, we have seen that obviousness is determined by an inquiry that initially takes into account the scope and content of the prior art, the differences between the claimed invention and the prior art, the level of skill of one of ordinary skill in the art, and any secondary evidence of nonobviousness. In a patent application examination at the USPTO, in order for an examiner to make an obviousness rejection of the invention, the examiner must present a prima facie case of obviousness. Prima facie is Latin for on the face of it, and it means that the patent examiner must put forth sufficient written argument or evidence in view of the appropriate legal precedence such that the claimed invention, as described in the specification and in view of the prior art,...

A probable first commercial use of a soy-based formulation in a high density structural foam polyurethane RIM system is from John Deere, Bayer, and G.I. Plastek, organizations that launched a commercial program during 2001. Beginning with the 2002 model year, John Deere Harvester Works entire line of combines included body panels molded with HarvestForm composite. 

One of the parts molded by G.I. Plastek using the soy-based Baydur material is the approximately 6 ft by 6 ft, 75 lb rear wall of the John Deere STS combine. G.I. Plastek adapted its proprietary ProTek inmold coating system to the new material so that John Deere could continue to enjoy the benefits of this cost-saving alternative to painting.

John Deere is testing fuel cell modules for off-road applications. Hydrogen is considered a good replacement for diesel in locomotives. Recent testing indicates that it could be economical for railroads. 

Section 103 of the Act requires that an invention described in a patent application must not have been obvious at the time the invention was made to a person having ordinary skill in the art to which [the] subject matter pertains. The fact that a companjr s experts may think that a new substance or process is highly novel does not necessarily exclude the possibility that the substance or products may not be obvious . The Patent and Trademark Office, and courts in potential infringement suits, assume an encyclopedic awareness of technical literature and product developments that no individual expert may have. The courts and the U.S. Patent and Trademark Office, in determining whether an invention is obvious, first establish the scope of the prior art, then the differences between the prior art and the patent claim, and finally the level of ordinary skill in the art.
