Duty not to misuse

Section 8 of the Act places a duty on all persons, whether they be employers, employees or self-employed, and states  [Pg.19]

Section 6 of the Act places duties on persons who design, manufacture, import or supply articles for use at work. They are required to ensure as far as is reasonably practicable that any plant, machinery, equipment or appliance is so designed and constructed as to be safe and without risk to health when used. They must also carry out any testing or examination necessary to achieve this and they must ensure that adequate information will be available about the use for which it was designed and about any conditions necessary for its safe use. [Pg.20]

A person who erects or installs such plants etc. must ensure so far as is reasonably practicable, that it is installed so as not to be unsafe or a risk to health when used. [Pg.20]

A person who manufacturers, imports or supplies any substance for use at work must ensure that, as far as is reasonably practicable, it is safe and without risk to health when used. There are requirements for testing, examination and research. They must also ensure that there is adequate information available about this and about any conditions necessary to ensure that it will be safe and without risks to health when used. [Pg.20]
