Under the FD C Act as enacted in 1938, adulterated and misbranded drugs may lawfully be exported but an unapproved new drug could not. This was a drafting error, but it was nonetheless enforced by FDA. Congress therefore enacted the Drug Export Amendments Act of 1986, which authorised the limited export of unapproved new human drugs and biological products after FDA had approved an export application. Since the original publication of this book, there has been a virtual mushroom revolution. Head shops and mail order houses now sell complete kits for home cultivation of Psilocybe cubensis (spores included). The flagrant ignorance of the law-makers is reflected in the fact that in Title 21 the alkaloid psilocin is misspelled as psilocyn. This small error is a product of the same mentality that classified cocaine as a narcotic in the 1922 Amendment to the Narcotic Drugs Import and Export Act and deliberately retains the error to this day. [Pg.2]

The Controlled Substance Act provisions relating to import or export are also amended, so that penalties for violations involving Rohypnol are equivalent to penalties for Schedule I drugs. A new penalty of up to three years imprisonment, or a fine, or both, is added for simple possession of Rohypnol. A new program is established to provide police departments with educational materials on the use of controlled substances during rapes and sexual assaults. [Pg.73]
