Deposition defending

Since the comments just quoted represent the only testimony by the defendant that deals directly with the controversial issue of his alleged involvement with Alchemy, the rest of this case must be prosecuted with evidence other than his depositions. Notwithstanding the two apparent disclaimers from... [Pg.9]

Sessile animals (and ones that are virtually so) have much the same problems in defending themselves and warding off predators as terrestrial plants. In fact, many of these animals supplement their food supply by means of symbiotic unicellular organisms, as do a few animals that move from place to place, but slowly. Most sessile marine animals feed upon material that is either suspended in the water or deposited on the substrate. This material sometimes contains metabolites that might be put to use defensively. However, the food is usually heterogeneous and relatively unpredictable as to content therefore, it does not supply a reliable source of metabolites. It is generally not used defensively, and such use is facultative. Some bivalves, however, do concentrate saxitoxin, derived from dinoflagellates, in tissues that are exposed to predators.13... [Pg.119]

Depositions. By permission of the court after jurisdiction has been obtained over any defendant in a civil case, or without such permission after an answer has been served, the testimony of any person, whether a party to the action or not, may be taken at the instance of any party by deposition upon oral examination or written interrogatories for the purpose of discovery, or for use as evidence in the action, or for both purposes. [Pg.116]

Alkanes occur naturally in places other than petroleum deposits. In insects, for example. The waxy alkanes dispersed in its cuticle help protect an insect from dehydration. Some insects use volatile alkanes to defend themselves or communicate with others of the same species. Alkanes even serve as starting materials that the insect converts to other biologically important substances. [Pg.99]

Another strategy is to prolong a case and to make the cost of litigation higher than the potential settlement. For example, a defendant s attorneys may find many experts for their case. During discovery the plaintiff s attorney may have to travel across the country many times to complete discovery depositions. [Pg.71]

A pharmaceutical company defended itself in multiple nuisance, trespass, and property damage claims arising from a 2008 flood that caused a wastewater pond to overflow into a creek, allegedly causing PCB-laden sediment to be deposited onto neighboring property. [Pg.17]
